原告小藺稱自己本想要前往韓國(guó)留學(xué)，辭去了原來穩(wěn)定的工作，并事前已經(jīng)積極聯(lián)系好了韓國(guó)的大學(xué)。一家韓國(guó)大學(xué)經(jīng)審理原告的資料后同意接受原告的留學(xué)申請(qǐng)，于是原告按學(xué)校的要求實(shí)際繳納了留學(xué)學(xué)費(fèi)，等韓國(guó)大使館辦理完畢留學(xué)簽證后即可出國(guó)留學(xué)。韓國(guó)大使館經(jīng)審查原告資料后，告知原告需提供親屬關(guān)系公證證明書及公證書的中英文對(duì)照版本后才即可辦理留學(xué)簽證。于是原告前往被告處辦理親屬關(guān)系公證書，并要求被告提供中英文對(duì)照公證書。被告受理原告相關(guān)公證申請(qǐng)后，于2013年1月10日作出公證書，對(duì)原告申請(qǐng)辦理的親屬關(guān)系證明以及中英文對(duì)照版本作出了相應(yīng)公證證明。原告拿到被告提供的公證書后，前往韓國(guó)大使館辦理相關(guān)出國(guó)留學(xué)簽證，但是，韓國(guó)大使館最后拒絕了原告的出國(guó)留學(xué)簽證申請(qǐng)，理由為原告提供的親屬關(guān)系公證證明錯(cuò)誤，懷疑原告提供虛假證明材料。至此，原告才知道被告提供的公證書中的英文翻譯存在多處明顯錯(cuò)誤，這讓大使館嚴(yán)重懷疑原告的誠(chéng)信，韓國(guó)學(xué)校將原告的學(xué)費(fèi)退回，導(dǎo)致原告出國(guó)留學(xué)的夢(mèng)想破滅，原告的人生軌跡發(fā)生了重大變化，對(duì)原告及原告家人帶來了巨大的傷害。

原告小藺庭審時(shí)稱，被告作為一家專業(yè)性的、專門的司法證明機(jī)構(gòu)，依法應(yīng)對(duì)提供證明材料的真實(shí)性、合法性予以保障，但由于被告的嚴(yán)重不負(fù)責(zé)任，提供的具有法律效力的證書存在多處明顯錯(cuò)誤，使得原告在辦理出國(guó)留學(xué)簽證被認(rèn)定為提供虛假證明材料，直接導(dǎo)致原告未能出國(guó)留學(xué)，對(duì)原告精神造成了巨大傷害。同時(shí)，原告因辦理出國(guó)留學(xué)事宜，前期已花費(fèi)了大量的人力財(cái)力，包括但不限于公證費(fèi)用、畢業(yè)證認(rèn)證費(fèi)用、體檢費(fèi)用、材料復(fù)印郵遞費(fèi)用及相關(guān)差旅費(fèi)用。被告公證處辯稱，原告沒有提供證據(jù)證實(shí)其申請(qǐng)出國(guó)簽證及不能辦理簽證手續(xù)的原因是因?yàn)楣C文書的錯(cuò)誤所致使，也沒有提供證據(jù)證實(shí)其經(jīng)濟(jì)損失情況，因此，原告的訴訟沒有事實(shí)和法律依據(jù)。

綜合全案證據(jù)，法院確認(rèn)以下法律事實(shí)：2013年1月10日，原告前往被告處辦理親屬關(guān)系公證書，被告根據(jù)原告提供的材料作出公證書，對(duì)原告申請(qǐng)辦理的親屬關(guān)系證明以及中英文對(duì)照版本作出了相應(yīng)的公證證明，但在英文翻譯版本中，筆誤譯錯(cuò)了“關(guān)系人related(譯錯(cuò)為relatted)”、“申請(qǐng)人applicant(譯錯(cuò)為applicantuo)”及“公證員 notary(譯錯(cuò)為notay)”三處。原告據(jù)此向法院起訴，認(rèn)為韓國(guó)大使館因?yàn)樵嫣峁┑挠H屬關(guān)系公證書中的英文翻譯存在多處明顯錯(cuò)誤、懷疑原告提供虛假證明材料，最后拒絕了原告的出國(guó)留學(xué)簽證申請(qǐng)，韓國(guó)學(xué)校將原告的學(xué)費(fèi)退回，導(dǎo)致原告出國(guó)留學(xué)的夢(mèng)想破滅，原告的人生軌跡發(fā)生了重大變化，對(duì)原告及原告家人帶來了巨大的傷害，要求被告賠償公證費(fèi)用、畢業(yè)證認(rèn)證費(fèi)用、體檢費(fèi)用、材料復(fù)印郵遞費(fèi)用及相關(guān)差旅費(fèi)用等合計(jì)人民幣2000元及精神損失費(fèi)人民幣10萬元。

一、公證書標(biāo)題的翻譯

一般來說，公證書翻譯為“notary certificate”。要注意，切忌將公證書翻譯成“notarial certification”。

公證書標(biāo)題必須全部大寫或大寫標(biāo)題中每個(gè)單詞的第一個(gè)字母。除非位于局首，公證書標(biāo)題中的冠詞（articles）及少于5個(gè)字母的連詞（conjunctions）、介詞（prepositions）不應(yīng)大寫。

在具體應(yīng)用中，涉外公證書翻譯工作量最多的往往是：畢業(yè)證公證書（notarization of diploma）、學(xué)位證公證書（notarization of degree certificate）、成績(jī)單公證書（notarization of academic transcription）、親屬關(guān)系公證書（notarization of family relation）、婚姻狀況公證書（notarization of marital status）、無刑事犯罪記錄公證書（notarization of no record of criminal offense）、及（涉外）收養(yǎng)公證書（notarization of adoption）等。

二、公證詞的翻譯

我國(guó)公證書公證詞多以“茲證明??”開頭，其英文翻譯（english equivalent）應(yīng)該是：“this is to certify that?”。

而外國(guó)公證書公證詞開頭一般為“我，xxxx，xxxx公證員，特此證明??”（i, xxxxx，notary public, duly authorised, admitted and sworn, practising in the city and county of dublin do hereby certify that??)。2.公證詞翻譯應(yīng)忠實(shí)于原文（conformity）

在結(jié)尾方面，中國(guó)公證書一般為“特此證明”，翻譯為“it is hereby certified”。

而外國(guó)公證書結(jié)尾一般為一段宣誓這類的語句，如“in faith and testimony whereof i have hereunto set may hand and affixed my seal of office this10th december 2008”。這段公證詞翻譯成中文比較費(fèi)解，一般來說采用意譯更符合中國(guó)國(guó)情，翻譯成“我宣誓，上述公證屬實(shí)??”。特別注意，英文公證詞結(jié)尾在描述日期上不使用“on”這個(gè)詞。

三、涉外公證書的落款

（2）當(dāng)事人的基本情況；（3）公證證詞；（4）承辦公證員的簽名（簽字章）、公證處印章和鋼?。唬?）出證日期等。英文公證書的格式比較規(guī)范，一般來說，公證地名寫在左上方，須全用大寫字母，ss.（或ss.)寫在地名中間。這個(gè)縮略語的意義不詳，有人認(rèn)為它代表拉丁字cilicet，表示to wit或namely（“即”），也有人認(rèn)為它有其他來源及含義。公證書正文應(yīng)和地名相隔三行。

一、公證書標(biāo)題的翻譯

一般來說，公證書翻譯為“notary certificate”。要注意，切忌將公證書翻譯成“notarial certification”。公證書標(biāo)題必須全部大寫或大寫標(biāo)題中每個(gè)單詞的第一個(gè)字母。除非位于局首，公證書標(biāo)題中的冠詞（articles）及少于5個(gè)字母的連詞（conjunctions）、介詞（prepositions）不應(yīng)大寫。

在具體應(yīng)用中，涉外公證書翻譯工作量最多的往往是：畢業(yè)證公證書（notarization of diploma）、學(xué)位證公證書（notarization of degree certificate）、成績(jī)單公證書（notarization of academic transcription）、親屬關(guān)系公證書（notarization of family relation）、婚姻狀況公證書（notarization of marital status）、無刑事犯罪記錄公證書（notarization of no record of criminal offense）、及（涉外）收養(yǎng)公證書（notarization of adoption）等。

二、公證詞的翻譯

我國(guó)公證書公證詞多以“茲證明??”開頭，其英文翻譯（english equivalent）應(yīng)該是：“this is to certify that?”。

而外國(guó)公證書公證詞開頭一般為“我，xxxx，xxxx公證員，特此證明??”（i, xxxxx，notary public, duly authorised, admitted and sworn, practising in the city and county of dublin do hereby certify that??)。2.公證詞翻譯應(yīng)忠實(shí)于原文（conformity）

在結(jié)尾方面，中國(guó)公證書一般為“特此證明”，翻譯為“it is hereby certified”。

而外國(guó)公證書結(jié)尾一般為一段宣誓這類的語句，如“in faith and testimony whereof i have hereunto set may hand and affixed my seal of office this10th december 2008”。這段公證詞翻譯成中文比較費(fèi)解，一般來說采用意譯更符合中國(guó)國(guó)情，翻譯成“我宣誓，上述公證屬實(shí)??”。特別注意，英文公證詞結(jié)尾在描述日期上不使用“on”這個(gè)詞。

三、涉外公證書的落款

（2）當(dāng)事人的基本情況；（3）公證證詞；（4）承辦公證員的簽名（簽字章）、公證處印章和鋼??；（5）出證日期等。英文公證書的格式比較規(guī)范，一般來說，公證地名寫在左上方，須全用大寫字母，ss.（或ss.)寫在地名中間。這個(gè)縮略語的意義不詳，有人認(rèn)為它代表拉丁字cilicet，表示to wit或namely（“即”），也有人認(rèn)為它有其他來源及含義。公證書正文應(yīng)和地名相隔三行。
