這周思修課學(xué)習(xí)的是與法律有關(guān)的內(nèi)容，在老師的安排下，我們觀看庭審現(xiàn)場(chǎng)的視頻，可以說(shuō)給我們提供了一個(gè)機(jī)會(huì)去接觸真正的司法實(shí)踐。通過(guò)觀看，我了解了一般的司法訴訟程序，也領(lǐng)略了法官，檢察官，辯護(hù)律師的風(fēng)采，增長(zhǎng)了許多法律知識(shí)。

第一個(gè)庭審案例講述的是：兩個(gè)從事文化管理相關(guān)工作的職員，甲方在相關(guān)文化部門(mén)工作，擁有一定職權(quán)。乙方在廣告公司工作，熟悉營(yíng)銷制作。甲在工作單位有參與決策權(quán)，當(dāng)他看到邀請(qǐng)相關(guān)企業(yè)參加學(xué)術(shù)交流性的會(huì)議可以收取許多費(fèi)用時(shí)，就心生貪念，想通過(guò)自己的虛假策劃來(lái)騙取錢(qián)財(cái)。于是，他就找到了有策劃經(jīng)驗(yàn)的乙方，二人假借國(guó)家某些協(xié)會(huì)的名義發(fā)布邀請(qǐng)函，偽造印章，詐騙錢(qián)財(cái)。

這個(gè)案例的兩人犯了偽造、變?cè)?、買(mǎi)賣(mài)國(guó)家機(jī)關(guān)公文、證件、印章罪。指非法制造、變?cè)?、買(mǎi)賣(mài)國(guó)家機(jī)關(guān)公文、證件、印章的行為。本罪在客觀方面表現(xiàn)為偽造、變?cè)?、買(mǎi)賣(mài)國(guó)家機(jī)關(guān)公文、證件、印章的行為。所謂偽造，是指無(wú)權(quán)制作者制作假的公文、證件或印章，既包括根本不存在某一公文、證件或印章而非法制作出一種假的公文、證件和印章，又包括在存在某一公文、證件或印章的情況下而模仿其特征而復(fù)印、偽造另一假的公文、證件或印章。既包括非國(guó)家機(jī)關(guān)工作人員的偽造或制作，又包括國(guó)家機(jī)關(guān)工作人員未經(jīng)批準(zhǔn)而擅自制造。另外，模仿有權(quán)簽發(fā)公文、證件的負(fù)責(zé)人的手跡簽發(fā)公文、證件的，亦應(yīng)以偽造論處。所謂變?cè)欤瑒t是對(duì)真實(shí)的公文、證件或印章利用涂改、擦消、拼接等方法進(jìn)行加工、改制，以改變其真實(shí)內(nèi)容。所謂買(mǎi)賣(mài)，即對(duì)國(guó)家機(jī)關(guān)公文、證件或者印章實(shí)行有償轉(zhuǎn)讓，包括購(gòu)買(mǎi)和銷售兩種行為。至于買(mǎi)賣(mài)的公文、證件或印章，既可以是真實(shí)的，也可以是偽造或者變?cè)斓?。根?jù)相關(guān)法律條款，偽造、變?cè)臁①I(mǎi)賣(mài)或者盜竊、搶奪、毀滅國(guó)家機(jī)關(guān)的公文、證件、印章的，處三年以下有期徒刑、拘役、管制或者剝奪政治權(quán)利；情節(jié)嚴(yán)重的，處三年以上十年以下有期徒刑。

第二個(gè)庭審案例：春節(jié)聯(lián)歡晚會(huì)中劇本、音樂(lè)等作品侵犯他人著作權(quán)的問(wèn)題，在現(xiàn)實(shí)生活中出現(xiàn)了較多案例，如李麗霞訴李剛、陳紅、蔡國(guó)慶侵犯鄰接權(quán)、錄音制作合同糾紛案，李麗霞認(rèn)為她作為那一年春晚作品《常來(lái)常往》伴奏錄音制品的共有人，對(duì)該伴奏錄音制品的編曲享有相應(yīng)的著作權(quán)和鄰接權(quán)，曲作者李剛未經(jīng)同意，將該伴奏錄音制品轉(zhuǎn)讓給他人使用并從中牟利，陳紅、蔡國(guó)慶明知該歌曲伴奏錄音制品存在權(quán)利瑕疵，但仍使用和播放，侵犯了她的著作權(quán)和鄰接權(quán)。法院最終認(rèn)定李麗霞所主張的編曲權(quán)即是著作權(quán)法中的錄音制作者權(quán)，雖然李麗霞確曾為伴奏帶的制作投入資金，但該出資并不是獲得制作者權(quán)利的對(duì)價(jià)，而是合作參選、分擔(dān)投資的方式，法院最后判決李剛退還李麗霞制作費(fèi)4千元，駁回了李麗霞的其他訴訟請(qǐng)求。

這個(gè)案例與著作權(quán)有關(guān)。著作權(quán)也稱版權(quán)，是指作者及其他權(quán)利人對(duì)文學(xué)、藝術(shù)和科學(xué)作品享有的人身權(quán)和財(cái)產(chǎn)權(quán)的總稱。著作權(quán)要保障的是思想的表達(dá)形式，而不是保護(hù)思想本身，在保障私人之財(cái)產(chǎn)權(quán)利益的同時(shí)，須兼顧文明之累積與知識(shí)之傳播，算法、數(shù)學(xué)方法、技術(shù)或機(jī)器的設(shè)計(jì)均不屬著作權(quán)所要保障的對(duì)象。實(shí)質(zhì)條件是指法律對(duì)作品的要求，大體有兩種標(biāo)準(zhǔn)。一種標(biāo)準(zhǔn)是只要特定的思想或情感被賦予一定的文學(xué)藝術(shù)形式，這種形式無(wú)論是作品的全部還是其中的局部，也不問(wèn)該作品是否已經(jīng)采取了一定物質(zhì)形式被固定下來(lái)，都可以依法被認(rèn)為是受保護(hù)的作品。另一種標(biāo)準(zhǔn)是，除了具備作為作品的一般條件，即表現(xiàn)為某種文學(xué)藝術(shù)形式外，還要求這種形式通過(guò)物質(zhì)載體被固定下來(lái)，才可以獲得著作權(quán)法保護(hù)。按照這種標(biāo)準(zhǔn)，口述作品以及一些即興創(chuàng)作的舞蹈、音樂(lè)、曲藝作品，就可能被排除在著作權(quán)法保護(hù)之外。我國(guó)著作權(quán)法采用第一種標(biāo)準(zhǔn)?？谑鲎髌返染梢猿蔀橹鳈?quán)法的保護(hù)對(duì)象。著作人身權(quán)是指作者通過(guò)創(chuàng)作表現(xiàn)個(gè)人風(fēng)格的作品而依法享有獲得名譽(yù)、聲望和維護(hù)作品完整性的權(quán)利。該權(quán)利由作者終身享有，不可轉(zhuǎn)讓、剝奪和限制。作者死后，一般由其繼承人或者法定機(jī)構(gòu)予以保護(hù)。根據(jù)中國(guó)《著作權(quán)法》的規(guī)定，著作人身權(quán)包括：發(fā)表權(quán)，即決定作品是否公布于眾的權(quán)利；署名權(quán)，即表明作者身份，在作品上署名的權(quán)利；修改權(quán)，即修改或者授權(quán)他人修改作品的權(quán)利；保護(hù)作品完整權(quán)，即保護(hù)作品不受歪曲、篡改的權(quán)利。

當(dāng)然，通過(guò)觀看我也了解庭審的程序：首先，審判長(zhǎng)詢問(wèn)被告人的基本情況，告知其有申請(qǐng)回避權(quán)、辯護(hù)權(quán)、最后陳述權(quán)等權(quán)利和如實(shí)陳述事實(shí)，遵守法庭紀(jì)律等義務(wù)。其次，進(jìn)入法庭調(diào)查階段，公訴人宣讀起訴書(shū)，詢問(wèn)被告人是否認(rèn)可。公訴人、辯護(hù)人、法官依次向被告人發(fā)問(wèn)，對(duì)起訴書(shū)的內(nèi)容逐項(xiàng)核實(shí)。再次，由公訴人出示證據(jù)，包括公安機(jī)關(guān)的抓獲經(jīng)過(guò)，證人證言，由被告人及律師逐一確認(rèn)。被告人及律師出示證據(jù)，然后由公訴人確認(rèn)證據(jù)。法庭辯論階段，公訴人發(fā)表公訴意見(jiàn)，指出犯罪事實(shí)應(yīng)當(dāng)承擔(dān)刑事處罰，說(shuō)明被告人主客觀都有犯罪事實(shí)，構(gòu)成犯罪要件，罪名成立。被告人及律師發(fā)表辯論意見(jiàn)，開(kāi)脫罪責(zé)，力爭(zhēng)無(wú)罪或降低懲罰。最后，由被告人做最后的陳述，審判長(zhǎng)宣布休庭，擇日宣判審判結(jié)果。

今天上思想道德修養(yǎng)與法律課基礎(chǔ)課，老師帶領(lǐng)我們觀看了法官庭審過(guò)程的視頻，這些視頻給我印象很深刻，我第一次了解到法官是如何執(zhí)法、評(píng)判的。

一打開(kāi)視頻呈現(xiàn)的場(chǎng)面就給人一種嚴(yán)肅而莊重的感覺(jué)。一上來(lái)是法官上場(chǎng)，然后就是法庭審判，首先法官讓罪犯自我介紹，接著問(wèn)了罪犯有關(guān)案件的具體過(guò)程，當(dāng)罪犯回答問(wèn)題模棱兩可時(shí)法官會(huì)及時(shí)提醒，讓他們說(shuō)關(guān)鍵問(wèn)題，當(dāng)一切問(wèn)題詢問(wèn)清楚，各項(xiàng)證據(jù)齊全，經(jīng)過(guò)公訴人與法官的商討，最后依據(jù)我國(guó)法律對(duì)罪犯進(jìn)行定罪。這一切說(shuō)起來(lái)輕巧，但實(shí)施起來(lái)卻不容易。

法官的高效辦案，科學(xué)合理進(jìn)行詢問(wèn)，在法定期限內(nèi)及時(shí)履行職責(zé)，不無(wú)故拖延時(shí)間、浪費(fèi)資源，這種辦事認(rèn)真的態(tài)度值得我們學(xué)習(xí)。他們對(duì)工作一絲不茍，認(rèn)認(rèn)真真，清正廉潔，遵守各項(xiàng)廉政規(guī)定，沒(méi)有利用法官職務(wù)和身份謀取不正當(dāng)利益，他們一心為民，落實(shí)司法為民的各項(xiàng)規(guī)定和要求，做到了聽(tīng)民聲、察民情、知民意，堅(jiān)持能動(dòng)司法，樹(shù)立服務(wù)意識(shí)，做好訴訟指導(dǎo)，風(fēng)險(xiǎn)提示，法律釋明等便民服務(wù)，避免了“冷硬橫推”等不良作風(fēng)。他們嚴(yán)守紀(jì)律，遵守各項(xiàng)紀(jì)律規(guī)定，不泄露個(gè)人隱私，他們敬業(yè)奉獻(xiàn)，熱愛(ài)人們司法事業(yè)，增強(qiáng)職業(yè)使命感和榮譽(yù)感，加強(qiáng)業(yè)務(wù)學(xué)習(xí)，提高司法能力，無(wú)私奉獻(xiàn)，他們遵守司法禮儀，執(zhí)行著裝規(guī)定，言語(yǔ)文明，舉止得體等等，他們身上這些優(yōu)點(diǎn)都值得我們學(xué)習(xí)。

在庭審過(guò)程中，罪犯主動(dòng)交代了自己犯罪行為，這件事情的起因是因?yàn)樽锓赶胍噘嵰恍╁X(qián)使得自己的生活過(guò)的好一些，因此才動(dòng)起了歪腦筋，他找到了一個(gè)同鄉(xiāng)，說(shuō)是有一個(gè)發(fā)財(cái)?shù)暮脵C(jī)會(huì)，那個(gè)人聽(tīng)了之后也心花怒放的，因此兩個(gè)人決定獲取不義之財(cái)。主犯利用自己的職位多次用低價(jià)采購(gòu)商品，然后和同鄉(xiāng)一起以高價(jià)賣(mài)出，以此來(lái)賺取差價(jià)來(lái)獲得利潤(rùn)。兩人一見(jiàn)錢(qián)來(lái)的如此容易，便一次又一次利用職位之便來(lái)獲取更多錢(qián)財(cái)，不料，事情敗漏了，兩人相繼被抓。

在法官審判過(guò)程中，兩人如實(shí)的交代了自己的犯罪過(guò)程，在最后的陳述中懺悔到：他們自己已經(jīng)意識(shí)到自己的錯(cuò)誤，他們會(huì)努力改正，希望法官給他們這個(gè)機(jī)會(huì)，爭(zhēng)取給他們寬大處理。雖然罪犯已經(jīng)認(rèn)識(shí)到自己的罪行是多么的大，但這也于事無(wú)補(bǔ)，他們將要接受的是法律的審判，他們要為自己的罪行負(fù)責(zé)。雖然法官很同情他們，但是，國(guó)有國(guó)法，家有家規(guī)，只要你犯錯(cuò)，你就要為自己的過(guò)錯(cuò)承擔(dān)應(yīng)有的懲罰，因此，經(jīng)過(guò)商議，法官按照國(guó)家憲法給他們定罪。

法官在審判過(guò)程里，一直嚴(yán)格遵守憲法紀(jì)律，將個(gè)人感情埋藏在心中，秉承著一顆忠于職守、秉公辦事的心，對(duì)罪犯、對(duì)案件進(jìn)行嚴(yán)格審理，不摻雜一點(diǎn)私人情感，最終做出了公正的審理，給罪犯，同時(shí)也是給受害人，更是給社會(huì)大眾還原一個(gè)真實(shí)的真相，讓大家了解事情的原委。

通過(guò)視頻讓我見(jiàn)識(shí)到法官的重要性。法官是評(píng)判一個(gè)片案件的關(guān)鍵人，如果法官不能做出正確的決定，會(huì)給使得受害人得到不公平的待遇，因此，法官一定要秉公辦事，收起自己的同情心，嚴(yán)格按照司法程序給大家一個(gè)交代。

法律是公正的，是嚴(yán)明的，同時(shí)也是不可侵犯的。我們的任何社會(huì)行為都受著法律的約束，試想一下，如果沒(méi)有法律，那么這個(gè)世界是怎樣的一鍋粥？搶劫，殺人，綁架，防火……不過(guò)是家常便飯而已。

我們作為一名大學(xué)生，應(yīng)該努力學(xué)習(xí)，遵紀(jì)守法，做一個(gè)講道德，守法律的好公民，將來(lái)成為一個(gè)對(duì)國(guó)家、對(duì)社會(huì)有幫助的人。

在看了《法外情》 《一級(jí)恐懼》 《一級(jí)重罪》 《沉默的羔羊》···等幾部精彩的電影之后，我收獲的不僅僅是視覺(jué)和情感上的沖擊、以及對(duì)人性和理性的思考，還了解到一些法律上的知識(shí)，通過(guò)中國(guó)與美國(guó)的法律電影認(rèn)識(shí)到它們法律制度的區(qū)別。

在這幾部電影中，最令人感動(dòng)的莫過(guò)于《法外情》了，影片情節(jié)曲折感人，部分片段有令人泫然而泣的效果。主要講述老妓劉惠蘭因自衛(wèi)殺死了出身名門(mén)的嫖客曾某，僅在倫敦大學(xué)法學(xué)院剛畢業(yè)的劉志鵬出于正義愿為她出庭作證。在種種的壓力下，憑著他的不屈不撓，與著名的主控官展開(kāi)一番舌戰(zhàn)唇槍，幾經(jīng)艱苦，終于得到勝利，使被告得以無(wú)罪釋放。這部影片提出當(dāng)時(shí)低下階層對(duì)社會(huì)貧賤富貴的控訴及法與情之間的矛盾，讓觀眾產(chǎn)生極大震撼與共鳴。它講述的這個(gè)故事讓人們認(rèn)識(shí)到原來(lái)在理性的法律制度下，還是有著真情存在的。都說(shuō)“法不容情”，可是若是心懷真情和正義，便終將會(huì)贏得勝利！法律只是一種保護(hù)權(quán)益的手段，它最終還是為了人們的權(quán)益而存在，為了正義而存在?？傊?，堅(jiān)持正義必勝！

《一級(jí)恐懼》是一部美國(guó)電影，電影講述芝加哥發(fā)生了一樁震驚全城的恐怖血案。德高望重的老主教羅森被人謀殺，身上共被刺了78刀。警察在現(xiàn)場(chǎng)抓到了滿手鮮血的少年艾倫。著名律師馬丁·威爾決定經(jīng)辦此案。他在拘留所看到了面色蒼白，稚氣未脫的艾倫，通過(guò)交談他認(rèn)為艾倫是無(wú)辜的，并決定免費(fèi)為他辯護(hù)。其中，有這樣一句臺(tái)詞，威爾對(duì)艾倫說(shuō)：“我來(lái)說(shuō)，你不必說(shuō)。你要做的就是看起來(lái)很無(wú)辜的坐在那?！睘槭裁匆憩F(xiàn)的很無(wú)辜呢？因?yàn)橐@取陪審團(tuán)的支持，陪審團(tuán)對(duì)一個(gè)案件的判決非常重要。在美國(guó)，審判中都會(huì)有陪審團(tuán)出現(xiàn)。在英美法系中，陪審團(tuán)制度是十分重要的一項(xiàng)制度，它對(duì)案件的判決起著十分重要的作用。因?yàn)榕銓張F(tuán)來(lái)自社會(huì)各個(gè)階層，一個(gè)案件的判決能夠說(shuō)服陪審團(tuán)，意味著能夠符合社會(huì)廣大階層的正義觀和價(jià)值觀。在我國(guó)，顯然是沒(méi)有陪審團(tuán)這一制度的，這也是中國(guó)和美國(guó)司法制度的最大不同之處。

這部影片劇情很精彩，讓我們對(duì)人性有了更深層的認(rèn)識(shí)與反思，影片最后威爾勝利了，成功為艾倫脫罪，他去向艾倫告別，大家都以為高潮已過(guò)全局終，正義戰(zhàn)勝邪惡。在受壓迫的弱者得以沉冤昭雪時(shí)，人性的秘密卻再一次被泄露出來(lái)——嚴(yán)重的不公經(jīng)歷是會(huì)對(duì)心理造成扭曲的，再純潔的靈魂也不會(huì)幸免遇難?；蛟S的確存在過(guò)羅伊與艾倫同時(shí)并存的時(shí)候，也許是在主教剛收留他，也許是很小的時(shí)候，被變態(tài)父親凌辱時(shí)，兩種面孔同時(shí)占據(jù)著他的身體。但最終，為了改變現(xiàn)狀，結(jié)束這令靈魂顫栗恥辱的一

切，懦弱的艾倫最終完全消失了，沒(méi)有等來(lái)任何及時(shí)救贖的純潔良知泯滅了，取而代之的，是憤怒，殘忍，暴力的羅伊，他更殘酷更強(qiáng)大，所以更適應(yīng)這個(gè)世界。就像影片最后羅伊向威爾喊的那樣，“你會(huì)感激我的，你總會(huì)變得心狠手辣?！逼餐柖ǘǖ卣驹谀抢?，沒(méi)人知道他在想什么。是否仍然相信人性本善呢，是否依舊如往日為他感興趣的殺人犯辯護(hù)，探究為何善良的人也會(huì)殺人。他是否仍然對(duì)自己的信仰堅(jiān)信不疑，還是僅僅將之歸結(jié)到自己洞察人性的能力不足呢。一切無(wú)從知曉，如同最后那首嘹亮澎湃的葡萄牙小曲一樣，鬼魅一樣的曲調(diào)，久久地盤(pán)旋在觀眾心中，亮麗而妖異如同夜幕下大海中折射著月光的美麗魚(yú)鱗，剔透晶瑩地隱現(xiàn)在暗潮洶涌的浪濤之間。法律雖然無(wú)法代表人性，但我們卻可以在這個(gè)過(guò)程中探索人性，思考和反思自身。

提到《一級(jí)重罪》，不得不提到案中的軍事法庭，軍事法庭與一般的法庭有所不同，因?yàn)榭赡軙?huì)涉及到國(guó)家機(jī)密，不能公開(kāi)審理，其中的一些制度、規(guī)則、稱呼都有一些不同。查理說(shuō)：“如果軍歌可以算作音樂(lè)，那么軍法可以算作司法”“軍法體制以否決為基礎(chǔ)，挑戰(zhàn)體制？NO，照體制內(nèi)的游戲規(guī)則，挑戰(zhàn)必輸無(wú)疑”，由此可見(jiàn)一斑。這部影片主要講述的是舊金山女律師克萊爾與成功商人湯姆一直過(guò)著令人羨慕的婚姻生活。然而這種平靜瞬息之間就被打破了，就在兩人在街巷中散步時(shí)，卻有不知何處來(lái)的大批軍警忽然把兩人圍住，把湯姆強(qiáng)行帶走。幾經(jīng)查問(wèn)，克萊爾終于被告知，丈夫曾是秘密軍人，而軍方現(xiàn)正指控他在巴西的薩爾瓦多犯下了“屠殺罪”！涉及國(guó)家機(jī)密，丈夫的案件不能公開(kāi)審理。軍事法庭又是軍隊(duì)高層說(shuō)了算，錄音帶不被采證，醫(yī)療保險(xiǎn)單不被采證，甚至克萊爾有可能被剝奪辯護(hù)資格。于是克萊爾找到了陸戰(zhàn)隊(duì)律師查理一同來(lái)調(diào)查這場(chǎng)詭異的官司。

看這部電影的時(shí)候感觸很大，為了國(guó)家的利益，為了上級(jí)的命令，海軍陸戰(zhàn)隊(duì)的官兵被國(guó)家洗腦，一件件罪惡滔天、任意殺伐的事出自他們的手下，事情敗露后總得有人頂雷，這個(gè)人要么是死去的人，要么是其中一名部下。

When i first watch this movie,i find one great problem which is the real name to this movie.I get two name for movie.One is The devil wear the pARADA,the other name is the queen wear the pARADA.these names have so many same place,but they have only one place diffierent whether is devil or queen.In my sight ,this perspective out a problem which relate to the values.Some people think the person who like Miranda priestly version of a workaholic is the devil which can't be understand by normal citizen who have not ambitions and ideal.Those people don't have to work enthsiasm.In these eyes,enjoy life is the kingly way.No more easliy than the freedom of anythingof value.Maybe this is the true meaning of American.But by my side,i think this situation is not only in America but in whole world!NOTHING SEEK WITHOUT MOTIVE!
